New Holland man charged with repeatedly firing gun in apartment waives preliminary hearing

A New Holland man charged with repeatedly firing an illegal gun inside his apartment will have his case proceed to county court after waiving his preliminary hearing earlier this month.

Seth Davies, 33, waived his preliminary hearing before Judge Jonathan Heisse on Jan. 16 on a felony count of discharging a firearm into an occupied structure, possessing a prohibited offensive weapon and recklessly endangering another person.

Davies is accused of firing the handgun 10 times inside his apartment in the 100 block of East Main Street during the early morning hours of Jan. 9.

Investigators found nearly a dozen shell casings and bullet fragments in Davies’ bedroom as well as holes in furniture, walls and a metal cabinet scattered throughout the residence.

Another weapon, a sawed-off shotgun, was recovered from underneath Davies’ bed and was found to have multiple illegal modifications.

Police were first called to the apartment complex shortly before 1 a.m. for a report of shots being fired from inside Davies’ unit, but were unable to make contact with him. Officers eventually entered Davies’ apartment after his mother provided them verbal consent to do so.

Davies remains in Lancaster County Prison in lieu of $15,000 bail. New Holland Borough Police Set.

Heather Halstead filed the charges. Assistant District Attorney Elizabeth Lapp will prosecute the case.

All defendants are presumed innocent until proven guilty.
