Dauphin County man sentenced up to six years in prison for sexually assaulting teenage girl in 2023

A Dauphin County man will spend three to six years in state prison after pleading guilty last month to sexually assaulting a 13-year-old girl in 2023.

Judge Merrill Spahn sentenced Tshetish Mizar, of the 100 block of Joya Circle, Lower Paxton Township, after Mizar pleaded guilty Dec. 19 to statutory sexual assault, aggravated indecent assault and indecent assault.

As part of the sentence, Mizar, 27, will also have to register as a sex offender under Megan’s Law and is to have no contact with the victim. Mizar will also be evaluated to determine if he is a sexually violent predator.

Appearing in a green prison jumpsuit, Mizar hung his head and stood silently except for when answering questions from Judge Spahn through a Nepalese interpreter. Mizar declined to address the court when given the opportunity to do so.

Mizar came to the victim’s Millersville residence when no one was home and told her to go to her room, she told investigators. Once there, Mizar proceeded to remove both of their clothes and then digitally penetrated the victim and sexually assaulted her despite her yelling at him to stop.

After the assault Mizar apologized to the victim and gave her $100, she told police. As Mizar was leaving the residence he encountered the victim’s younger brother and gave him $10 as well.

A forensic examination of Mizar’s cellphone showed he traveled to the victim’s residence the afternoon of May 31, 2023, matching the date and time that the victim had told investigators the assault took place. Additional analysis of Mizar’s cellphone also showed he had communicated with the girl numerous times.  

Police began investigating the sexual assault in August 2023 when Mizar returned to the victim’s residence during the early morning hours, prompting a call for a reported burglary in progress. The victim, who was not in Pennsylvania at the time, told investigators she led Mizar to believe she was at the residence so he would go there and police could respond and arrest him for the sexual assault.

Millersville Borough Police Lt. Jason Scott filed the charges.

Assistant District Attorney Jessica Collo prosecuted the case.
